1. Acceptance of Terms

By accessing or using Ideadig.com (the “Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you (“User”) and Ideadig.com (“Ideadig”, “we”, “us”, or “our”), operated from Switzerland.

2. Description of Service

Ideadig provides a web-based platform offering tools for business idea discovery, ideation, and validation. This includes access to innovation databases, success story archives, TRIZ-based frameworks, and data-driven validation reports. Features are subject to the subscription plan selected by the User.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract to use the Platform. By registering, you represent and warrant that you meet these requirements. The Platform is intended for professional and business use.

4. Account Registration

To access the Platform, you must create an account using a valid email address and a password. You agree to:

Provide accurate and complete information at registration.
Keep your login credentials confidential and not share them with others.
Notify us immediately at support@ideadig.com if you suspect unauthorized access to your account.

You are solely responsible for all activity that occurs under your account.

5. Subscription Plans and Payment

Access to certain features of the Platform requires a paid subscription. By subscribing, you agree to the following:

Fees: Subscription fees are displayed at checkout and are charged in advance on a recurring basis (monthly or annual, as selected).
Payment processing: Payments are handled by a third-party payment processor. We do not store your payment card information.
Renewals: Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date.
Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access until that date.
Refunds: As a general policy, subscription fees are non-refundable. If you believe you have been charged in error, please contact us at support@ideadig.com within 14 days of the charge.
Price changes: We reserve the right to change subscription pricing. We will give at least 30 days’ advance notice of any price increase, and such changes will take effect at your next renewal.

6. AI Credits

Certain features on the Platform — specifically AI-powered frameworks — are powered by AI Credits. The following rules apply to AI Credits:

Inclusion with subscription: Each subscription plan includes a set allocation of AI Credits, which are granted upon purchase or renewal of your subscription.
Reset on renewal: AI Credits are reset to zero and recharged to their plan allocation at the start of each billing cycle. Unused credits from a previous period are forfeited and do not carry over.
Top-up purchases: You may purchase additional AI Credits within the Platform at any time. However, any unused top-up credits are also reset to zero upon subscription renewal. Top-up credits are non-refundable.
Credit consumption: Each AI framework execution consumes a variable number of AI Credits depending on the complexity of the task and the AI model used. The credit cost per run is displayed before execution where technically feasible.
Variable pricing: The credit cost of individual framework runs may change at any time without prior notice. This may occur because Ideadig uses third-party AI model providers whose pricing or models may change. We will endeavour to reflect such changes in the Platform interface promptly.
No monetary value: AI Credits have no monetary value, cannot be transferred between accounts, cannot be exchanged for cash or other consideration, and expire upon account termination or subscription cancellation.
No guarantee of availability: Ideadig does not guarantee that any specific AI model or framework will remain available. We reserve the right to change, replace, or discontinue AI-powered features at any time.

By using AI Credits, you acknowledge and accept that credit costs are variable and subject to change, and that unused credits — including purchased top-ups — are forfeited at renewal.

7. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

Use the Platform to infringe the intellectual property rights of any third party.
Attempt to reverse engineer, scrape, or extract data from the Platform in bulk without our express written consent.
Use automated tools, bots, or scripts to access the Platform in an unauthorized manner.
Share, resell, or sublicense access to the Platform or its content to third parties.
Upload or transmit any malicious code, spam, or harmful content.
Interfere with the integrity or performance of the Platform or its infrastructure.

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these Terms.

8. Intellectual Property

All content on the Platform — including databases, frameworks, validation reports, text, graphics, and software — is the intellectual property of Ideadig or its licensors and is protected by Swiss and international copyright law. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your own internal business purposes. You may not copy, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

9. User-Generated Content

If you submit content to the Platform (e.g., saved ideas, notes, or feedback), you retain ownership of that content. By submitting it, you grant Ideadig a limited license to store and display that content solely for the purpose of providing the service to you. We do not use your submitted content for any commercial purpose without your consent.

10. Third-Party Services

The Platform may integrate with or reference third-party services, websites, or tools. Ideadig is not responsible for the content, accuracy, or practices of third-party services. Any use of third-party services is at your own risk and subject to their respective terms and policies.

11. AI and Data-Driven Tools

The Platform uses artificial intelligence models and third-party data sources to generate insights, validation reports, and ideation outputs. You acknowledge that:

AI-generated outputs are provided for informational purposes only and do not constitute legal, financial, or investment advice.
Results may not be exhaustive or error-free. You are responsible for independently verifying any information before making business decisions.
Ideadig does not guarantee any specific outcome from use of the Platform’s tools or frameworks.

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, Ideadig disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the maximum extent permitted by Swiss law, Ideadig shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising out of or relating to these Terms shall not exceed the total subscription fees paid by you to Ideadig in the three (3) months preceding the event giving rise to the claim.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We will make reasonable efforts to notify paid subscribers in advance of any material changes that affect their subscription.

15. Termination

You may terminate your account at any time by cancelling your subscription and contacting us at support@ideadig.com. We may suspend or terminate your account immediately if you breach these Terms, if required by law, or to protect the integrity of the Platform. Upon termination, your right to access the Platform ceases immediately.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Switzerland. If you are a consumer resident in the European Union, you retain any rights afforded to you under mandatory EU consumer protection laws.

17. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or via a notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those changes.
